Terms of Service

1. Acceptance of Terms

These Terms of Service are a legally binding agreement between you and Thriving Silver Minds LLC. By registering for or using our services, you agree to be bound by these Terms. If signing up on behalf of another person, you represent that you have the right to do so and accept responsibility on their behalf.

2. Description of Services

Thriving Silver Minds LLC provides virtual social wellness programming for seniors including guided group sessions, recreational activities, and community connection. Our services are strictly social and recreational in nature. We are not a licensed medical provider, therapist, counselor, or any form of clinical healthcare service. Participation does not create a patient-provider relationship.

3. Eligibility

Services are designed for adults, primarily seniors aged 55+. You must be at least 18 to enter this agreement.

4. Membership & Billing

4.1 Monthly Membership

Membership is $79.00/month (8 sessions — 2 per week). Rates may change with 30 days written notice.

4.2 Payment

Payment is collected verbally by your Care Specialist. No charges occur without your explicit verbal authorization.

4.3 Billing Cycle

Billing date established during intake call. Charges occur on the same date monthly.

4.4 Failed Payments

If payment fails, we notify you and retry for 5 business days. Services may be suspended if payment cannot be collected.

5. Cancellation & Refunds

5.1 Cancellation

Cancel anytime by contacting your Care Specialist. No contracts, no penalties.

5.2 Exceptions

In the event of a member’s death or documented serious medical emergency, a full refund of the current month’s fee is issued upon documentation.

6. Code of Conduct

All members must treat others with respect. Prohibited: harassment, discriminatory language, deliberate disruption, sharing others’ information, solicitation, and illegal activity. Violations may result in removal without refund.

7. Third-Party Enrollment Authority

If registering on behalf of another person, you represent: (1) you are 18+; (2) member has consented; (3) all information is accurate; (4) you accept personal responsibility for payment and compliance. You are the primary account holder.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, THRIVING SILVER MINDS LLC, ITS OWNERS, OFFICERS, EMPLOYEES, CARE SPECIALISTS, AND SESSION HOSTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. Total liability shall not exceed amounts paid in the 30 days preceding any claim. Our services are social and recreational only.

9. Disclaimer of Warranties

OUR SERVICES ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND. WE MAKE NO REPRESENTATIONS REGARDING SPECIFIC HEALTH OR COGNITIVE OUTCOMES.

10. Privacy

Governed by our Privacy Policy, incorporated herein by reference.

11. Modifications

Material changes communicated by email 30+ days before taking effect. Continued use constitutes acceptance.

12. Governing Law

Governed by U.S. law and the state of registration of Thriving Silver Minds LLC. Disputes resolved through good-faith negotiation, then binding arbitration per the American Arbitration Association.
